Landed Estates & Heritage Property

Boodle Hatfield has been providing leading landed estates with strategic planning and tailored advice for nearly 300 years. Today we act for over sixty of the largest and oldest landed estates in the country, as well as many other landowners.

Throughout our long history we have consistently represented the owners of rural and urban estates. We are proud to have advised some of the wealthiest families in the UK on their personal, tax, trust and property matters for several generations.

Our approach in advising clients and their businesses is to listen first. We understand that each estate and family is unique and we tailor our advice to meet your different needs and objectives rather than adopting a one size fits all approach.

We believe that a wealth of relevant knowledge and practical experience in relation to landed estates together with our legal expertise in the field provide a highly competent and client-sensitive framework through which we can really “add value” in this historic and unique sector.

We advise on ways to protect family wealth including how to guard against financial, legal and reputational risk and taking preventative measures designed to mitigate the impact of divorce or death. We ensure the transition of wealth from generation to generation is effective, tax efficient and focused on your family’s objectives.

Having identified the need to diversify, many landed estates run businesses to maintain their integrity and upkeep. We have worked with many clients on their diversification plans for example establishing successful property companies, farming operations or, increasingly, exhibiting inherited art collections.

As one of the fastest growing asset classes, art can play a vital role in the income of a landed estate today. Anyone who inherits an item, or items, of cultural importance will eventually be faced with the question of "should I be doing anything with this?". We are well versed in helping clients to navigate the question and reach the right conclusion.

How we help

Succession planning

We provide timely and holistic long-term succession planning for the devolution of family estates and associated businesses.

Taxation

We advise on all tax issues relating to historic buildings and chattels, including conditional exemption claims, gift and leaseback sales, purchases and gifts of art (including import and export issues), loans to museums and provenance issues.

Philanthropy

We advise on all aspects of philanthropy and socially responsible activities, recognising their significance and importance to our clients.

Smaller estates

We understand the requirements of smaller rural, family-owned estates, and can advise on first-time acquisitions of farms and estates.

Track Record

  • Helping the family prepare a Court Application for a set of family trusts containing significant chattels, agricultural estate and property in London and elsewhere, to extend the lives of the trusts for a further 125 years together with securing more modern provisions for the trusts and further trust powers to give flexibility and opportunities for tax planning.
  • Advised a family with a very significant collection of chattels, advising on Inheritance Tax planning opportunities including negotiating with various institutions on open access requirements.
  • Advising on the potential incorporation of both an urban estate and part of a rural estate, both owned in complex trust structures.
  • Advising a rural estate on the implementation of a CGT arrangement over land earmarked for development, banking both the gain to date and future gain at the previous rate.
