Kellie's practice encompasses a wide range of commercial and property litigation. Kellie has substantial experience in dealing with all aspects of property litigation, including enforcing freehold restrictive covenants, party wall claims, enfranchisement litigation and claims under the Trusts of Land and Appointment of Trustees Act 1996. Kellie acts for estates, freeholders, landlords, tenants and individuals. Kellie also advises on all landlord and tenant matters in commercial, residential and mixed use buildings, including advising on business lease renewals, both contested and uncontested, service charge issues and breaches of covenant including dilapidations, repair, alterations, assignment and remedies, including forfeiture.

Kellie also has experience in dealing with general commercial disputes, with a particular focus on partnership disputes, high value contractual claims, misrepresentation and enforcement. Kellie acts for international clients and high net worth individuals.

Kellie has experience of acting for clients in proceedings in the First Tier Tribunal (Property Chamber), Upper Tribunal (Lands Chamber), County Courts, High Court, Commercial Court and Court of Appeal.

Kellie regularly contributes to Practical Law's dispute resolution and property dispute resolution blogs. Kellie trained at Boodle Hatfield and qualified in 2005.

Kellie's Recent cases

  • acting for a claimant purchaser in a misrepresentation claim against the vendor for breach of the sale agreement, which settled at mediation.
  • acting for a landlord on a redevelopment of a large site involving in excess of 20 tenants, some of which had protection under the Landlord and Tenant Act 1954, including providing strategic advice on obtaining vacant possession by the date the development was due to start while maintaining the income stream for as long as possible and dealing with multiple proceedings under the 1954 Act.
  • acting for a claimant in the defendant's appeal to the Court of Appeal on the extent to which section 21 of the Limitation Act 1980 applies to a claim against a company director for breach of fiduciary duty.
  • successfully defending a claim brought against our client by his former partner in an LLP for allegedly overdrawing his share of the LLP's profits by approximately £5 million. 
  • representing a third party respondent to a Norwich Pharmacal Order in the JSC BTA Bank litigation.
  • representing a claimant company in successfully opposing applications to set aside two default judgments in the Chancery Division that we had obtained on the claimant's behalf against the defendant, who was a guarantor of a loan of £5 million from our client that had not been repaid. Obtaining an order for sale of the Defendant's penthouse apartment in Knightsbridge and subsequently obtaining vacant possession and defeating an application for an injunction to prevent exchange taking place.
